* RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT The registrant, being an attendant at the 2023 Pan American Maccabi Games in Buenos Aires, Argentina (the “Attendant”), and the parent of the Attendant (“Parent” or “Parent(s)”), agree to all the terms and conditions set forth in this agreement (“Agreement”) with Maccabi Canada: 1. I, the Attendant, (my child, if the Attendant is a minor), acknowledge and agree that in consideration of being permitted to attend the 2023 Pan American Maccabi Games in Buenos Aires, Argentina (the “Pan American Maccabi Games”) organized, staged and/or operated by Maccabi Canada that I (my child if the Attendant is a minor) agree to all the terms and conditions set forth in the Agreement: 2. I acknowledge on behalf of my child, (if Attendant is a minor) that my (or my child’s, if Attendant is a minor) attendance at the Pan American Maccabi Games may entail known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to my child, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the Pan American Maccabi Games. I expressly agree and promise to accept and assume all of the risks existing in the attendance at the Pan American Maccabi Games. My attendance is purely voluntary and I elect to attend in spite of the risks. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Maccabi Canada, and its directors, officers, employees, sponsors, independent contractors and agents (collectively, “Maccabi Canada”) and to waive any and all claims, demands, or causes of action that I have or may have in the future against Maccabi Canada and to release Maccabi Canada from any and all liability for any loss, damage, expense or injury including death that I (or my child, if the Attendant is a minor) may suffer or that my family, heirs, assigns, personal representatives and estate may suffer as a result of my (or my child, if the Attendant is a minor) attendance at the Pan American Maccabi Games DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY OF CARE OWED UNDER THE OCCUPIERS' LIABILITY ACT, R.S.O. 1990c. O. 2 (or any other similar legislation applicable in any other jurisdiction) ON THE PART OF MACCABI CANADA AND FURTHER INCLUDING THE FAILURE ON THE PART OF MACCABI CANADA TO SAFEGUARD OR PROTECT ME FROM THE RISKS, DANGERS AND HAZARDS OF ATTENDING THE PAN AMERICAN MACCABI GAMES. 3. I HEREBY ACKNOWLEDGE AND AGREE THAT: The Pan American Maccabi Games may be dangerous, exposing attendants to many risks and hazards, some of which are inherent in the very nature of the Pan American Maccabi Games itself, others which result from human error and/or negligence on the part of the persons involved in organizing, staging and/or operating the Pan American Maccabi Games; • I am aware that the risks include, but are not limited to, the potential for serious personal injury, death, property damage, or illness (e.g., communicable diseases such as SARS, avian flu (H5N1), MRSA, influenza, and COVID-19). I understand the risks may be relative to my own state of fitness and health (including physical, mental, and emotional), and to the awareness, care, and skill with which I conduct myself: • as a result of the aforesaid risks and hazards, I as an Attendant (my child, if the Attendant is a minor) may suffer serious personal injury, even death, as well as property and / or financial loss; • some of the aforesaid risks and hazards are foreseeable, but others are not; • I (my child, if Attendant is a minor), nevertheless freely and voluntarily assume all of the aforesaid risks and hazards, and agree thatattendance at the Pan American Maccabi Games shall be entirely at my own risk; • I (my child, if Attendant is a minor), understand that neither Maccabi Canada nor any of its directors, officers, employees, sponsors, independent contractors or agents assume any responsibility whatsoever for my safety during the course of my attendance at the Pan American Maccabi Games. I have carefully read this RELEASE AND WAIVER of LIABILITY AND ASSUMPTION OF RISK AGREEMENT (the "Agreement") and acknowledge that I fully understand it and that I am freely and voluntarily executing it; I clearly understand that by signing this Agreement I am FOREVER PREVENTED FROM SUING OR OTHERWISE CLAIMING against Maccabi Canada, its directors, officers, employees, sponsors, independent contractors and agents for any loss or damage connected with any property loss or personal injury that I may sustain while attending the Pan American Maccabi Games, regardless of whether such loss or injury is caused solely or partly by the negligence or breach of contract or breach of duty of Maccabi Canada or any of its directors, officers, employees, sponsors, independent contractors and/or agents; In addition to the above, I also RELEASE Maccabi Canada and its directors, officers, employees, sponsors, independent contractors and agents from any and all liability, and DO HEREBY WAIVE as against Maccabi Canada and its directors, officers, employees, sponsors, independent contractors and agents any and all recourses, proceedings, claims, and causes of action arising out of the Ontario Family Law Act, R.S.O. 1990 c. F.3, as amended, or any other similar provincial or federal legislation, in respect of any and all personal injuries or property losses which I or my child may suffer arising out of or connected with my attendance (my child, if Attendant is a minor) the Pan American Maccabi Games, notwithstanding that such injuries or losses may have been caused solely or partly by the negligence or breach of contract or breach of duty of Maccabi Canada, or any of its directors, officers, employees, sponsors, independent contractors or agents. I have been given the opportunity and have been encouraged to seek independent legal advice prior to acknowleding this Agreement; I clearly understand that Maccabi Canada will not permit me (my child, if Attendant is a minor), to attend the Pan American Maccabi Games unless I execute this RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION of RISK AGREEMENT. I UNDERSTAND THAT IN THE EVENT THAT I (my child, if Attendant is a minor), AM NOT ABLE TO ATTEND FOR ANY REASON, INCLUDING BUT NOT LIMITED TO ANY SICKNESS, INCLUDING THOSE ASSOCIATED WITH COVID-19, I AGREE TO FORFEIT ANY AND ALL MONIES PAID TO DATE TO MACCABI CANADA. This RELEASE and WAIVER of LIABILITY AND ASSUMPTION of RISK AGREEMENT is binding on myself, my heirs, my executors, administrators, personal representatives and assigns; This Agreement may be in addition to another agreement I must sign as a condition of attending the Pan American Maccabi Games and I agree that I am bound by the terms and conditions of both agreements; and I agree that I (my child, if participant is a minor), am physically capable of attending the Pan American Games and that I have no pre-existing conditions that would hinder my ability to attend the Pan American Games. I agree that I (my child, if Attendant is a minor), will comply with any and all COVID requirements and recommendations of National, Provincial and local public health and other governmental authorities and to those additional health and safety regulations put in place by Maccabi Canada, as they pertain to the COVID-19 Coronavirus, and to adopt all necessary measures to that effect. BY ACKNOWLEDGING THIS AGREEMENT I AGREE AND UNDERSTAND THAT I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I HAVE READ THIS DOCUMENT CAREFULLY AND HAVE HAD THE OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE ABOUT THE DOCUMENT.
